Mistrial Declared in Charlie Tan Murder Trial After 7 Days of Deliberations
ROCHESTER, N.Y. — After seven days and more than 50 hours of deliberations, a hung jury has been declared in the Charlie Tan murder trial.
The Pittsford man was accused and tried for the murder of his father, Jim Tan this past winter. The judge declared a mistrial Thursday morning after jurors failed to reached a verdict after seven full days of deliberation.
Tan, a former Cornell University student, is charged in the fatal shooting his father Jim Tan in their Coach Side Lane home back in February. The jury was not allowed to consider a lesser charge in this case, just the charge of murder in the second degree.
While the defense had said that the suspect and his family suffered abuse at the hands of the victim for years, the prosecution used that same argument to establish that the murder was calculated and planned by Charlie Tan.
All parties are due back in court on Nov. 5. Charlie Tan remains free on bail.
Everyone is due back in court Nov. 5. Judge Piampiano said Charlie will remain out of custody until that time. It’s expected on that date the prosecution will officially say it plans to re-try Charlie Tan.(TWC News)
