Court Strikes Out Osun PDP’s Suit Against Aregbesola On Demolition
An Osun State High Court sitting in Osogbo, state capital has struck-out a suit filed by the major opposition party in the state, the Peoples’ Democratic Party (PDP) against the Governor of the state, Ogbeni Rauf Aregbesola over demolition of party’s secretariat fence.
The presiding judge, Justice Adeyinka Aderibigbe quashed the suit for being incompetent.
He therefore upheld the preliminary objection filed by the state legal team from the state Ministry of Justice to represent the defendants.
The defence team led by the Director of Litigation and Advisory Service, Barr. Olajide Obisakin appeared with Barrister Hassan Agbelekale of the state Ministry of Justice.
Justice Aderibigbe also held that there was no suit pending before him since being withdrawn by the plaintiff‘s counsel, Mr. Taofeek Tewogbade, during the proceeding on 1st April, 2014.
The state PDP Chairman, Alhaji Ganiyu Olaoluwa, had approached the court with a suit seeking to restrain the government of Osun from bulldozing the part of wall fencing the party’s secretariat that also serves as President Goodluck Jonathan’s campaign office in the state.
The plaintiff had joined the state Attorney General and Commissioner of Justice, Mr. Wale Afolabi in the suit seeking to allow the fence of the secretariat located along Gbongan/Ibadan Expressway in Osogbo to remain undemolished in spite of the ongoing road expansion in the area.
But the trial judge dismissed the case paving way for the state government to demolish the controversial fence in continuation of its road expansion project.
