Court Strikes Out Omisore’s Suit Against Aregbesola, Others
A High Court sitting in Osogbo yesterday struck out a suit filed by the gubernatorial aspirant of the Peoples Democratic Party (PDP) in the August 9 governorship election in Osun State, Senator Iyiola Omisore against Governor Rauf Aregbesola and two others.
Omisore had dragged Aregbesola to court over the constitution of a Standing Commission of Inquiry on Disturbance of Public Peace that he inaugurated on 15th May, 2014.
He had approached the court to declare the action of the governor illegal, contending that the commission was inaugurated to witch-hunt him in particular, owing to the widely reported fracas involving him and a former governor of Osun State, Senator Isiaka Adeleke.
Senator Adeleke had alleged that he was assaulted by Omisore and others at a hotel this year.
But the court in its ruling held that under the 1999 constitution as amended as well as extant law (s) of the state, specifically the Commission of Inquiry Law 2002, the governor has an unfettered statutory power to institute a Commission of Inquiry into any matter in the state as he may deem necessary and that the claims of the plaintiffs are at best speculatory.
The presiding judge, Justice Akin Oladimeji went further to state that the plaintiffs in one breath agreed that the governor of the state, Ogbeni Rauf Adesoji Aregbesola has the power, as conferred by law, to inaugurate the commission being complained against, and in another breath asked the court to restrain the said commission from performing her duties as constituted.
Consequently, the action failed and was struck out for lacking merit and being of no moment in law.
