Abuja Federal High Court Judge Sacks Adamawa Acting Governor, Orders Swearing-in of Ngilari
A Federal High Court in Abuja has ordered the inauguration of former Deputy Governor of Adamawa State, Mr. Bala Ngilari, as the new governor of the state.
Justice Adeniyi Ademola, in his judgment, ruled that the purported resignation of Ngilari on July 14, 2014 was invalid, null and void, supporting his Plaintiff’s argument that it breached the provisions of sections 306(1), (2) and (5) of the 1999 Constitution because it was addressed to the Speaker and acted upon by the House of Assembly.
He ruled that Ngilari’s letter was written while Nyako was still governor and did not hold as it wasn’t addressed to him, rendering the resignation null and void.
His ruling now means that the Adamawa state governorship bye-election slated for scheduled by INEC, will no longer hold.
